What the FCC ruling changed for AI voice calls

In February 2024 the FCC confirmed that AI-generated voices in calls fall under the TCPA, which puts artificial-voice calls to consumers in the same bucket as prerecorded ones: they generally require prior express consent. The amended Telemarketing Sales Rule adds penalties up to $53,088 per violation and a five-year record retention requirement, and campaigns that dial ahead of agent availability must keep abandoned calls at or below 3% of live answers.

Calls to business lines sit largely outside the National Do Not Call Registry, which is why most automated calling is sold into B2B first, though that exemption is narrower than teams assume and several states set a higher floor than the federal one.
