Acceptance of these terms

By using coldcalls.ai or signing up for ColdCalls.ai, you agree to these terms of service. If you are acting on behalf of an organization, you agree on its behalf and confirm you are authorized to do so. If you do not agree, do not use the service. Any connected, production use of ColdCalls.ai is also governed by the specific agreement and onboarding documentation established with each customer, which prevails over these website terms where they differ.

What ColdCalls.ai is

ColdCalls.ai is an AI cold calling SDR. When connected to your CRM and calendar, it places outbound calls with an AI voice agent that discloses up front that it is an AI calling on your behalf, qualifies leads, handles objections, and books meetings, to help you fill your pipeline. It runs on top of your existing CRM and calendar, on a flat monthly fee per seat, and provides compliance tooling such as AI disclosure, real-time Do Not Call scrubbing and configurable calling hours.

The service supports your outbound process. You remain responsible for the leads you call, your consent basis, the accuracy of your data, and how you communicate with the people you contact. You can review and control your script, calling hours, disclosure language and qualifying questions.

Your responsibilities

You are responsible for using the service in line with all laws that apply to you, including the Telephone Consumer Protection Act (TCPA), federal and state Do Not Call rules, state laws governing AI and artificial-voice calls, and consumer protection and telemarketing rules. You agree to only call leads you have the right to contact and the appropriate consent to call, to keep your suppression and Do Not Call data current, and to configure your calling hours and disclosure accordingly. ColdCalls.ai provides compliance tooling to support your program, but you are responsible for your own lists, your consent, and the way you run your campaigns. You agree to provide accurate information and to only connect accounts and data you have the right to use.

Acceptable use

ColdCalls.ai is intended for legitimate business-to-business and business-to-consumer outbound by companies calling their own prospects in compliance with applicable law. You agree to use the service responsibly and to comply with all applicable laws, professional standards and codes of conduct.

You agree not to use the service to:

• Call people you do not have the right or consent to contact, or contact anyone in ways that break the law, including ignoring Do Not Call requests.
• Disable or circumvent the AI disclosure, DNC scrubbing, calling-hour or frequency controls, or use the service to deceive the people you call.
• Submit data you do not have the right to use, or that infringes someone else\'s rights.
• Send lead lists or other sensitive records through this marketing website, which is not built to receive them.
• Attempt to disrupt, reverse engineer, scrape, or overload the service or circumvent its limits.
• Resell or redistribute the service except under a written agreement with us.

You are responsible for the data you connect and how you use the output.

Your content and data

As between you and us, you keep all rights to the data you submit and to the outputs you receive, including call recordings and transcripts. You grant us only the limited permission needed to provide the service to you. As described in our privacy policy, this website does not connect to your CRM or calendar or dial your lead lists. Any handling of lead lists, call recordings, consent and Do Not Call data within a connected, production deployment is governed by your customer agreement.

Accounts and access

You must provide accurate information when you sign up and keep any credentials secure. You are responsible for activity that happens under your account. Tell us promptly if you believe your account or access has been used without your permission.

Plans, billing and refunds

ColdCalls.ai is offered on paid plans only, with no free plan, billed as a flat monthly fee per AI SDR seat. Additional connected minutes beyond your plan are billed at the published per-minute rate. All prices and charges are in US dollars. Subscriptions renew automatically, monthly or yearly depending on the term you choose, until cancelled in line with your agreement. Except where required by law or stated in your agreement, payments are non-refundable. The specific commercial terms for your organization are set out in your order or agreement with us, which controls where it differs from this section.

Service availability

We work to keep ColdCalls.ai available and performing well, but we do not guarantee uninterrupted access. We may update, change or temporarily suspend features to maintain and improve the service. Service levels for a production deployment, where applicable, are set out in your agreement.

Intellectual property

ColdCalls.ai, including its software, models, interface, content and brand, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these terms and your agreement. You may not copy, modify, distribute or create derivative works from the service except as expressly permitted. The names of other companies and products referenced on this site are used for identification only and remain the property of their respective owners.

Disclaimers

To the fullest extent permitted by law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service is error-free or that any specific number of meetings booked, connect rate or pipeline outcome will result. We provide compliance tooling, but we do not provide legal advice, and you remain responsible for your own legal compliance. The figures shown on this site are typical outcomes, not guarantees.

Limitation of liability

To the maximum extent permitted by law, ColdCalls.ai and its team will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, data or goodwill, arising from your use of the service. Nothing in these terms limits liability that cannot be limited by law. Our total liability for any claim will not exceed the amount you paid us for the service in the twelve months before the claim, unless your agreement provides otherwise.

Termination

You can stop using the service at any time, subject to your agreement. We may suspend or terminate access if you breach these terms or use the service in a way that risks harm to others or the platform, including non-compliant calling.

Changes to these terms

We may update these terms as the service evolves. When we make material changes we will update the date above and, where appropriate, notify you. Continued use after changes means you accept the updated terms.

Governing law

These terms are governed by the laws of [governing jurisdiction], without regard to its conflict-of-laws rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, except where your customer agreement specifies otherwise.
